LOTTERY FULL TERMS AND CONDITIONS
1. These Terms and Conditions are the Weekly Lottery Rules. By entering the lottery, players agree to be bound by these rules.
2. This lottery is being promoted by and on behalf of St Raphael’s Hospice and administered by its External Lottery Management Company, Sterling Lotteries of Barrow in Furness https://sterlinglotteries.co.uk
3. For the purpose of the Gambling Act 2005, this lottery is defined as a 'Society Lottery'.
4. The promoter, St Raphael’s Hospice is licensed by The Gambling Commission in accordance with the Gambling Act 2005.
5. To enter the lottery, you must be resident in Great Britain and aged 18 (eighteen) or over. Underage play is an offence.
6. The Promoter reserves the right to carry out any age-verification checks that it deems necessary in order to confirm age eligibility to participate in the Lottery. Any person found to be under 18 years of age who has entered the Lottery will be excluded from future entries and any sums paid over by them will be returned and, if applicable, any prizes won will be withheld.
7. There will be 18 guaranteed weekly cash winners, plus 1 rollover cash prize of £200 per week which, if not won, will rollover up to a maximum of £10,000 when it will become a guaranteed prize. Additional prizes may be offered from time to time - details will be posted on our website at the time.
8. All entries shall be priced at £1 (one pound) each.
9. All lottery entry sales are final and no refunds shall be made at any time. All entrants acknowledge that their payment of £1 per entry to enter the lottery does not guarantee that they will win any prize.
10. We will write to confirm your entry in the Lottery and the date of your first entry, within 14 days. The letter will also contain your unique draw number(s). Please note that it will take time to process your application and therefore it may take up to 14 days before you are entered into the Lottery. Where the payment method is by Direct Debit, the Direct Debit must be set up and activated before entry into the weekly draw.
11. St Raphael’s Hospice and the External Lottery Management company may each hold ‘Customer Funds’ as defined by the Gambling Commission. These Customer Funds are held in a segregated ‘client’ bank account to protect the funds in the event of the insolvency of either party. This level of protection is described as ‘medium’ by the Gambling Commission.
12. The draw for the prizes will be made at our External Lottery Management company’s premises to be held weekly. You do not need to be present at the draw to win the lottery. A list of winner’s titles, last name and area will be published on our website www.straphaels.org.uk and are available by phoning us on 0370 241 4506.
13. If a cash prize is awarded, this will be made by cheque in the name of the entrant only.
14. St Raphael’s Hospice reserves the right in exceptional and unforeseen circumstances to substitute any non-cash prizes acquired for the lottery for a similar prize at St Raphael’s Hospice absolute discretion.
15. Whilst every effort will be made to contact winners, if we are unable to make contact within 6 months of the draw, unclaimed prizes will be used to fund the St Raphael’s Hospice vital work. If a cheque payment from the Promoter remains uncashed after 6 months of the draw, this prize will be forfeited and also used to fund St Raphael’s Hospice service.
16. Full payment for each ticket must be received either in the form of cash or cleared funds before the entry/ticket can be entered into the draw. Only tickets for which full payment has been received either in the form of cash or cleared funds is eligible to win the prize.
17. The winners of the lottery prizes will be notified by posted letter and/or phone.
18. All entrants are solely responsible for providing St Raphael’s Hospice with their accurate and up-to-date contact details and St Raphael’s Hospice will be in no way liable for any failure or inability to contact any entrant due to any errors, omissions or inaccuracies in the contact details that the entrant has provided. In the event that an entrant changes their contact details, they will be solely responsible for advising St Raphael’s Hospice of the change.
19. By accepting the prize, the winner agrees to take part in promotional activity and St Raphael’s Hospice reserves the right to use the surname and town of the winner, their photograph and audio and/or visual recordings of them in any publicity unless prior notification has been received.
20. Each game number is unique. A randomly selected game number will be issued with the confirmation of entry.
21. Lottery players can be cancelled at any time by notifying St Raphael’s Hospice in writing, by phone or via e-mail. If you pay your lottery subscription by direct debit/standing order you will also need to contact your bank to cancel your entries.
22. St Raphael’s Hospice shall not be liable to the players for any loss or damage suffered or arising from:
- any delays or failures in the postal service or other delivery methods used by St Raphael’s Hospice or the player from time to time.
- any delays or failures in any software or other systems used by St Raphael’s Hospice. for the administration of the lottery.
- any delays or failures in the banking system used by St Raphael’s Hospice or the player.
- any refusal by St Raphael’s Hospice to accept registration of an individual as a player or the cancellation of an entry.
- any failure to enter a chance into the draw.
- any event beyond the reasonable control of St Raphael’s Hospice.
23. Nothing within these terms and conditions shall create or should be construed as creating any form of contract between any entrant and St Raphael’s Hospice.
24. Any complaints and disputes will be dealt with in accordance with our complaints policy, a copy of which is available from Supporter Care. In the event of a dispute not being resolved, it will be referred to Alternative Dispute Resolution (ADR). As St Raphael’s Hospice is a member of the Hospice Lotteries Association this will be referred to The Independent Betting Adjudication Service Limited (IBAS).
25. St Raphael’s Hospice is committed to protecting the privacy of players Data that is collected from the member is used lawfully in accordance with the Data Protection Act 2018 and is will be used for the purpose of processing lottery chances, subsequent entry into the lottery draw, and informing winners that they have won aprize. In addition, details of players of St Raphael’s Hospice Lottery will be added to St Raphael’s Hospice supporter database in order to receive information about the Hospice and other information directly relating to the work of the Hospice. If any player does not wish to receive such information they may ask to be taken off thatmailing list by contacting St Raphael’s Hospice, Fundraising Department, London Road, North Cheam, SUTTON SM3 9DX or via email lottery@straphaels.org.uk. In that eventuality, the data will only be maintained and used for the sole purpose of administration regarding St Raphael’s Hospice Lottery.
26. Any player has the right to access the information held about them. To obtain this information, please contact the Hospice in writing: St Raphael’s Hospice, Fundraising Department, London Road, North Cheam, SUTTON SM3 9DX or via email lottery@straphaels.org.uk.
27. St Raphael’s Hospice will not sell, rent or grant access of any personal data to any third party without express prior permission.
28. St Raphael’s Hospice reserves the right to amend these rules at any time. If St Raphael’s Hospice does this, it will publish the amended rules on the Hospice website: www.straphaels.org.uk.
29. St Raphael’s Hospice reserves the right to disqualify any player if it has reasonable grounds to believe the player has breached any of these rules.
30. St Raphael’s Hospice personnel responsible for the promotion of the lottery is Miss Sara Jane Woods, Commercial Director. Neither St Raphael’s Hospice nor our lottery management company shall be liable to you in contract, tort [1], negligence or otherwise for any indirect or consequential loss suffered by you in relation to your participation in the Lottery (including loss of the opportunity to enter the Lottery and / or the chance of winning a prize). [1] A tort is a civil wrong that causes a claimant to suffer loss or harm, resulting in legal liability for the person who commits the tortious act; tort law can be contrasted with criminal law, which deals with criminal wrongs that are punishable by the state.
31. Each player should retain a copy of these Terms and Conditions for their reference.
32. This lottery is a form of gambling. Participants are encouraged to gamble sensibly. Should gambling become a problem we recommend you contact BeGambleAware National Gambling Helpline Tel: 0808 8020 133 or visit their website on www.BeGambleAware.org.
33. If you feel like you have a problem with gambling you can self-exclude from all of the Promoter’s society lotteries for a minimum period of six months and up to a period of five years, if required. Any self-exclusion period may, on request, be extended for one or more further periods of at least six months.
34. You can self-exclude by filling in the self-exclusion form on the St Raphael’s Hospice website by contacting St Raphael’s Hospice.
35. The Laws of England and Wales shall govern the interpretation and/or enforcement of these Terms and Conditions and St Raphael’s Hospice Lottery and all players hereby submit to the exclusive jurisdiction of the English courts.
